HDB defects liability period: report before you renovate

A new flat carries a one-year defects liability period, and most owners treat it as a formality. The order you use it in decides who pays. Report first and renovate second, because a contractor's work becomes a competing explanation for the damage.

What the defects liability period covers, and what it never did

The period covers what HDB built, and nothing you added afterwards. Every newly completed flat carries a one-year defects liability period running from the date of key collection. Inside that window, HDB's project contractor rectifies imperfections in the building work handed over to you. Cracked floor tiles, a door that does not close square, seepage through a wall, a badly finished window frame. These belong to HDB because HDB's contractor built them.

Your aircon sits outside that scope from the moment it goes in. HDB does not supply the system in a new flat, so no part of it enters the defects liability period. The indoor units, the condensing unit on the ledge, the piping, the drain line and the brackets all belong to the contract you signed with your installer. That contract carries its own product cover and its own workmanship warranty. Those are the paths a faulty install runs through.

The confusion is understandable, because both protections run in parallel through your first year in the flat. Two parties stand behind two different things at the same time. HDB stands behind the shell. Your installer stands behind the system fitted into it. Neither absorbs the other's faults, and a claim filed with the wrong party wastes the window you had with the right one.

Reporting runs through HDB's own channel rather than through your contractor or interior designer. A rectification request can be submitted online or at the Building Service Centre serving your precinct. Once the one-year period closes, HDB's position is that you engage a repair contractor yourself, with your HDB Branch available if you need further assistance. That closing date is worth writing down somewhere you will see it.

Why the reporting order decides who pays

HDB asks owners to report defects before renovation works begin, and the reason is causation rather than paperwork. A defect reported in an untouched flat has one plausible source, which is the construction. The same defect reported after a renovation crew has been through has at least two. Reporting first removes the need to work out whether the fault was inherent from HDB's construction or caused by the renovation.

Renovation introduces a competing explanation for almost any damage you find later. Drilling, coring, wet trades and heavy trolleys all leave marks on a flat. Once that work has happened, a cracked tile near the ledge doorway is no longer obviously a construction flaw. It could be the flooring contractor's trolley. The claim does not automatically fail. It stops being straightforward, and the burden of explaining shifts towards you.

Aircon installation is among the more invasive trades in a renovation, which puts it squarely inside this problem. It puts holes through walls, fixes load onto the ledge, runs trunking along ceilings and cuts a drain path into the flat's plumbing. Every one of those touches a surface HDB handed over intact. A defect found on any of them after the installer has left is a defect with two candidate owners.

The sequencing rule follows from that, and it is short. Inspect the flat while it is empty. Report everything you find, including items that look cosmetic. Let the rectification happen. Then start renovation, aircon included. Owners who reverse those steps rarely lose a claim outright. They lose the ease of it, and they spend the argument in the middle of a renovation they are already trying to manage.

What aircon installation physically does to a new flat

Three parts of an aircon installation cut into surfaces HDB handed over. The first is the wall penetration. Refrigerant pipes and the drain line run from each indoor unit out to the ledge, and that route needs holes through internal and external walls. HDB's renovation conditions do not permit hacking or coring of structural members to run pipes, so the route has to be planned around structure rather than through it.

The second is the ledge. HDB is specific that the aircon ledge is for the condensing unit and nothing else, and that unit gets bracketed onto a surface which arrived new. Fixings go into concrete. Rubber padding sits under the base. If the ledge shows damage later, whether the fixing caused it or the ledge arrived that way is exactly the question you did not want to be arguing.

The third is drainage, and it produces the most disputes. Condensation water has to discharge into a floor trap inside the flat, and HDB requires the piping to run internally rather than along an external face. That means a drain path threaded through the flat's own finishes and plumbing. A line set at the wrong fall, or a joint that was not seated properly, puts water somewhere that looks nothing like an aircon fault to a homeowner.

Photograph those three areas before the installer arrives. Wide shots of each wall the piping will cross, the ledge surface and its edges, and the floor trap the drain will feed. It takes a few minutes. It is also the only record that separates the flat's condition at handover from its condition after the trade, and nobody produces that evidence retrospectively.

Is a new leak a building defect or an installation fault?

A leak after aircon installation has three possible owners, and telling them apart is the whole job. It can be a building defect the installation happened to expose. It can be an installation fault. It can be both at once, where a marginal building condition and a marginal install combine into a problem neither would have caused alone. The third case is the one that gets settled badly.

Water that has nothing to do with the aircon running points towards the building. Staining that appears in wet weather rather than during operation is one signal. Seepage along a wall shared with a bathroom or an upstairs flat is another. So is damp that tracks a ceiling line away from the drain route. None of these follow the unit's on and off cycle, and that independence is the strongest signal available without tools.

Water that tracks the unit's operation points towards the install. Dripping that starts soon after switch-on and stops once the unit is off is the clearest of them. Water at the indoor unit's body, rather than on the wall below it, is another. So is a drip that worsens on humid days, when the unit produces more condensate. A drain line with too little fall behaves exactly like this, and so does a poorly seated joint.

If an installer tells you a first-year leak is a building defect, ask what test supports that before you take it to HDB. A drainage check is quick, and it either clears the install or does not. Sending an installation fault into HDB's rectification process burns time in a window that has an end date, and it comes back unresolved. The reverse mistake costs less, but it still delays the actual fix.

The order that keeps both protections open

Run the flat's inspection before any trade is booked, not after the renovation quote is signed. Walk every room with the lights on and the windows open. Check floors, walls, ceilings, doors, windows, taps and the ledge. Write down everything, including marks that look too small to matter. A cosmetic item reported early costs nothing to include. The same item found after renovation is a conversation.

Nobody in the renovation chain owns this step for you. An interior designer coordinates trades and a contractor executes them, but the defect report sits between the flat owner and HDB. Owners often assume the designer has handled it, because the designer handled everything else. Ask who is submitting it, and ask before the first trade is booked rather than after.

Submit the full list in one go rather than in instalments as you notice things. Rectification work happens inside your flat, and a contractor returning for a second round after your renovation has started creates its own scheduling problem. Reporting online, or at the Building Service Centre for your precinct, puts the list on record with a date attached. The date is the part that matters later.

Only once rectification is done should the renovation sequence begin, and aircon fits into that sequence at a specific point. Pipe and drain routes get decided before ceilings and carpentry close them in. That makes the aircon layout one of the earlier decisions in a renovation, even though the units themselves may be mounted much later. Confirming the route early avoids undoing finished work to change it.

If renovation has already begun, the period has not closed and the report is still worth making. State plainly what work has been done, when it happened, and which areas the trades touched. None of that guarantees the outcome. It does give the assessment something to work with, instead of leaving the gap to be filled with assumptions. An owner who volunteers that timeline reads as more credible than one who leaves it out.

The parallel protection: your installer's workmanship warranty

The workmanship warranty is the aircon-side equivalent of the defects liability period, and it deserves the same discipline. It covers how the system was fitted rather than what the system is. A flare joint that leaks, a drain set at the wrong fall, a bracket left untightened, a unit mounted out of level. These are workmanship items. They go back to the installer, not to the manufacturer and not to HDB.

Its window rarely lines up with either of the others, which is why the three dates need writing down together. Product cover on the equipment often runs longer than the workmanship cover on the labour. HDB's period runs its own year from key collection. A fault appearing well into your second year might sit inside one of the three and outside the other two. Knowing which one before you make the call saves a wasted claim.

Ask for the workmanship terms in writing before the installation is scheduled, in a section separate from the equipment warranty. Keep the quotation, the model labels, the installation report submitted to HDB and your dated defect list in the same place. Those four documents answer most responsibility questions without an argument. Assembling them after a dispute has started is considerably harder than assembling them on the day.

The two protections do different jobs, and neither substitutes for the other. HDB's period protects the flat you were handed. The workmanship warranty protects the work you commissioned. Used in the right order, with the inspection and the report coming first, both stay intact. Used in the wrong order, the first one weakens and the second carries weight it was never meant to carry alone.
